• Waste Permit Regulations

    The Waste Management (Facility Permit and Registration) Regulations 2007 SI No 821 of 2007 as amended by the Waste Management (Facility Permit and Registration) Regulations 2008 SI No 87 of 2008 came into affect on the 1st June 2008.

    This replaces the Waste Management (Permit) Regulations 1998.

    Key changes to Waste Management (Facility Permit and Registration) Regulations 2007 as amended

    • Provision to enable the EPA to decide on whether, having regard to particular circumstances, the facility requires a waste licence or permit.
    • Empower local authorities to recover all or part of the reasonable costs incurred by ongoing monitoring of compliance with a facility permit, including the costs of inspections and investigations.
    • A local authority shall not grant a waste facility permit unless it is satisfied that the facility is planning compliant. 
    • Empower local authorities to attach such conditions to a waste facility permit as are necessary to give effect to the objectives of regional Waste Management Plans or the National Hazardous Waste Management Plan.
    • Empower local authorities to attach such conditions to a waste facility permit as are necessary to encourage sound environmental management of waste and in particular to encourage waste prevention, re-use, recycling and recovery.

    Waste Collection Permits

    The Waste Management (Collection Permit) Regulations, S.I. 820 of 2007 and Waste Management (Collection Permit) (Amendment) Regulations S.I. 87 of 2008, which came in to effect on the 01st June 2008, set out the procedures for the making of waste collection permit applications, public consultation, consideration by local authorities of submissions in relation to waste collection permit applications, and the grant, refusal and review of waste collection permits by local authorities.

    Please note these regulations are subject to amendment from time to time.

    Those intending to carry out waste collection activities in a Local Authority area must apply for a waste collection permit. This requirement applies to individuals, companies and partnerships.

    On the 01st of February 2012, Offaly County Council was designated as the Nominated Authority for the processing of all new Waste Collection Permit applications and review applications received on or after that date. This single Nominated Authority will be known as the National Waste Collection Permit Office (NWCPO).

    From 01st February 2012, all applications for new or reviewed waste collection permits shall be processed by the:

You are advised to engage in a pre-application consultation prior to lodging an application.

    Note: In accordance with Section 34 of the Waste Management Acts, 1996, as amended, a person collecting waste for the purposes of reward, with a view to profit or otherwise in the course of business, may only do so under and in accordance with a Waste Collection Permit.
    In certain circumstances the requirement to hold a waste collection permit may be exempted by ministerial regulation, subject to the collection being carried out in compliance with such requirements as are specified in the regulations.
